User Agreement

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND SEA DOG FILMS PTY LTD ATF FOR THE KATO FAMILY TRUST ABN 23257209747 ("Sea Dog Films Pty Ltd") , BY INSTALLING THE DVD AND DOWNLOADING ITS CONTENT YOU AGREE TO ACCEPT AND BE COVERED BY THESE CONDITIONS.

DEFINITIONS

"The Content" means any photographic image. "You" includes the customer and any other party acting on your behalf.

GRANT OF LICENCE

Once You have paid the fee agreed with Sea Dog Films Pty Ltd, Sea Dog Films Pty Ltd grants You a non-exclusive licence to use The Content subject to the restrictions in this Agreement.

PERMITTED USE

You may use The Content in your personal computer whether it be a PC, MAC or LINUX operating system as a wallpaper/screen saver and use The Content in your mobile phone, or device as a wallpaper/screen saver.

NOT PERMITTED USE

You may not use The Content in a Website, post The Content on any bulletin board, or place The Content on-line in a downloadable format. You may not use any of The Content to create defamatory or obscene material. You may not resell, transfer or grant any rights to The Content or any compilation or derivative work containing The Content to any other person or entity without the prior written consent of Sea Dog Films Pty Ltd .

TERMINATION

If you use The Content in a way not permitted by this Agreement without prior written consent from Sea Dog Films Pty Ltd You will infringe Australian copyright law. If You do not comply with the conditions of this Agreement, this licence automatically terminates. On termination, all copies of The Content must be returned to Sea Dog Films Pty Ltd immediately.

COPYRIGHT

The Copyright in all of The Content is owned by Sea Dog Films Pty Ltd or its licensors and is protected by Australian and international Copyright laws and other applicable laws. No title or intellectual property rights in The Content are transferred to You. All rights not expressly granted by this licence are retained by Sea Dog Films Pty Ltd

LIMITED WARRANTY

Sea Dog Films Pty Ltd warrants The Content to be free from defects in material for 30 days from delivery. Your only remedy for a breach of this warranty is the replacement of The Content.
